License Terms – END-USER LICENSE AGREEMENT
This DocTools End-User License Agreement (“EULA”) is a legal agreement between you (either an individual or a single entity) and DocTools ApS (hereafter DocTools) for the DocTools software product and related documentation, which includes computer software and may include associated media, printed materials, and online or electronic documentation (“SOFTWARE PRODUCT”).
By installing, copying, or otherwise using the SOFTWARE PRODUCT, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the SOFTWARE PRODUCT.
In addition, by installing, copying, or otherwise using any updates or other components of the SOFTWARE PRODUCT that you receive separately as part of the SOFTWARE PRODUCT (“UPDATES”), you agree to be bound by any additional license terms that accompany such UPDATES. If you do not agree to the additional license terms that accompany such UPDATES, you may not install, copy, or otherwise use such UPDATES.
1. LICENSE TO USE THE SOFTWARE PRODUCT
1.1 GENERAL GRANT OF LICENSE. This EULA grants you the following rights:
The SOFTWARE PRODUCT is licensed, not sold. A license is granted only after the payment of the license fee. However, for SOFTWARE PRODUCTS provided free of charge by DocTools, a license is granted without payment.
After the license fee has been paid or a license has been granted by DocTools without payment, you may install and use one copy of the SOFTWARE PRODUCT or any prior version on a single computer or on a single removable disk.
The SOFTWARE PRODUCT must NOT be installed on a network where it could be used by more than a single computer.
The primary user of the computer on which the licensed SOFTWARE PRODUCT is installed may make additional copies for his or her exclusive use on one or more additional computers.
1.2 MULTI-USER LICENSE: a multi-user license can only be used by individuals within the same organization. The general grant of license in Section 1.1 is extended to other individuals within your organization up to the maximum number of individuals covered by the license. For example, if this software was licensed to 5 users within your organization, your organization may make and use copies of the SOFTWARE PRODUCT according to the terms of Section 1.1 provided that no more than 5 individuals use the SOFTWARE PRODUCT.
2. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS
Limitations on Reverse Engineering, Decompilation, and Disassembly. You may not reverse engineer, decompile, or disassemble the SOFTWARE PRODUCT.
DocTools may provide you with support services related to the SOFTWARE PRODUCT (“Support Services”). Any supplemental software code provided to you as part of the Support Services shall be considered part of the SOFTWARE PRODUCT and subject to the terms and conditions of this EULA. With respect to technical information you provide to DocTools as part of the Support Services, DocTools may use such information for its business purposes, including for product support and development. DocTools will not utilize such technical information in a form that personally identifies you.
All titles and copyrights in and to the SOFTWARE PRODUCT (including but not limited to any images, photographs, animations, video, audio, music, text, and applets incorporated into the SOFTWARE PRODUCT), any accompanying printed materials, and any copies of the SOFTWARE PRODUCT are owned by DocTools or its suppliers. The SOFTWARE PRODUCT is protected by copyright laws and international copyright treaties as well as other intellectual property laws and treaties. Therefore, you must treat the SOFTWARE PRODUCT like any other copyrighted material except that you may install the licensed SOFTWARE PRODUCT on a single computer provided you keep the original solely for backup or archival purposes.
4. LIMITED WARRANTY
In no event shall DocTools be held liable for any damages arising from the use of this SOFTWARE PRODUCT.
DocTools warrants that (a) the licensed SOFTWARE PRODUCT will perform substantially in accordance with the accompanying written materials for a period of ninety (90) days from the date of receipt, and (b) any Support Services provided by DocTools shall be substantially as described in applicable written materials provided to you by DocTools, and DocTools will make commercially reasonable efforts to solve any problem issues. Some states and jurisdictions do not allow limitations on duration of an implied warranty, so the above limitation may not apply to you. To the extent allowed by applicable law, implied warranties on the SOFTWARE PRODUCT, if any, are limited to ninety (90) days.
DocTools shall not be liable for any effects on the licensed SOFTWARE PRODUCT caused by changes in the functionality or capabilities of Microsoft Word after the date of receipt, including changes “pushed out” via Microsoft Update or Automatic Updates.
No warranty is offered for SOFTWARE PRODUCTS provided free of charge.
